    According to Apple’s comments filed with the Copyright Office as part of the 2009 DMCA triennial rulemaking, jailbreaking an iPhone constitutes copyright infringement and a DMCA violation. This is Apple’s first formal public statement on its legal stance on iPhone jailbreaking.

    Therefore, the United States Librarian of Congress is required to issue exemptions to the Digital Millennium Copyright Act’s anti-circumvention clause, which makes it a crime to work around encryption or Digital Rights Management protecting copyrighted materials.

    Among the exemptions proposed by the public, that would allow consumers to jailbreak their phones in order to install third-party applications available from sources other than Apple’s App Store. The Electronic Frontier Foundation (EFF) submitted the proposal, which argues that end users should be allowed to jailbreak their phones in order to use legally obtained third-party applications. The proposal even claims that legalizing jailbreaking could benefit Apple by making the iPhone more appealing to consumers.

    After considering all the facts, the Copyright Office stated in 2010 that jailbreaking smartphones does not violate the DMCA. However, it is illegal to download paid apps for free or to use your phone for criminal purposes.
